1. Acceptance of Terms
By accessing and using the Fotoprynt application ("Service"), you accept and agree to be bound by the terms and provision of this agreement. In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services. Any participation in this service will constitute acceptance of this agreement. If you do not agree to abide by the above, please do not use this service.
2. User Accounts
To access certain features of the Service, you must register for an account. When you register for an account, you may be required to provide us with some information about yourself, such as your email address or other contact information. You agree that the information you provide to us is accurate and that you will keep it accurate and up-to-date at all times. You are solely responsible for maintaining the confidentiality of your account and password.
3. User Content
You are solely responsible for the photos and other content that you upload, publish or display ("Content") on or through the Service. You warrant that you own or have the necessary licenses, rights, consents, and permissions to your Content. You agree not to upload any Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable or that infringes on any third party's rights, including privacy and intellectual property rights. We reserve the right, but are not obligated, to remove or disable access to any Content that we believe, in our sole discretion, violates these terms.
4. AI Services and Credits
The Service offers AI-powered features for photo enhancement, editing, and photobook generation ("AI Services"). Use of these AI Services may require "AI Credits". You may receive a complimentary number of credits upon signing up, and you may purchase additional credits. Credits are deducted from your account upon the successful completion of an AI task. We are not responsible for the aesthetic or subjective outcome of AI-generated content. Credits are non-refundable, but we may, at our discretion, restore credits if a technical failure on our end prevents an AI task from completing.
5. Orders and Payment
All orders for prints, photobooks, or other products are subject to our acceptance. We reserve the right to refuse or cancel any order for any reason. Prices for products are subject to change without notice. All payments are handled through a third-party payment processor. By providing a credit card or other payment method, you represent and warrant that you are authorized to use the designated payment method.
6. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
7. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. We expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranty that the Service will meet your requirements or be available on an uninterrupted, secure, or error-free basis.
